Why Should We Mediate If We Know What We Want?

I get this question at least once a week from amicable spouses - "why should we choose the mediation process if we know what we want?".


Many people believe that mediation is needed if you have conflict. But that's not the case! The mediation process is the only legal process that allows both parties to create the terms of a separation agreement together in a collaborative way.


All other options that lead to resolution (lawyer led negotiation, arbitration & court) pit spouses against each other in a win/lose scenario. In the mediation process, spouses work together toward a mutually satisfactory outcome. Further, it's the only forum in which families can deviate from the law and create their own custom-fit post-separation plan.
